Majelis Panel Hakim 1 yang memeriksa perkara ini yakni Ketua MK Suhartoyo didampingi Hakim Konstitusi Daniel Yusmic P. Foekh dan Hakim Konstitusi M. Guntur Hamzah.Lebih lanjut Titi menjelaskan bahwa Pasal 7 ayat (2) huruf n Undang-Undang Nomor 10 tahun 2016 dimaknai bahwa satu periode jabatan kepala daerah terhitung dari yang pernah dijalani setidak-tidaknya setengah masa jabatan. "Di mana masa jabatan yang telah dijalani tersebut adalah masa jabatan, baik yang menjabat secara definitif maupun penjabat sementara, sepanjang telah dijalani secara nyata atau riil atau faktual dan bukan masa jabatan yang dihitung berdasarkan waktu pelantikan," ujar Titi.Adapun Pasal 7 ayat (2) huruf n yang dimaksud, berbunyi, “Calon Gubernur dan Calon Wakil Gubernur, Calon Bupati dan Calon Wakil Bupati, serta Calon Walikota dan Calon Wakil Walikota sebagaimana dimaksud pada ayat (1) harus memenuhi persyaratan sebagai berikut, (...) belum pernah menjabat sebagai Gubernur, Wakil Gubernur, Bupati, Wakil Bupati, Walikota, dan Wakil Walikota selama 2 (dua) kali masa jabatan dalam jabatan yang sama untuk Calon Gubernur, Calon Wakil Gubernur, Calon Bupati, Calon Wakil Bupati, Calon Walikota, dan Calon Wakil Walikota.



Pendapat berbeda disampaikan I Gde Pantja Astawa selaku ahli yang dihadirkan Pihak Terkait (Pasangan Calon Bupati dan Wakil Bupati Tasikmalaya Nomor Urut 3, Ade Sugianto dan Iip Mipathul Paoz). Jika ahli dari Pemohon memaknai hitung-hitungan masa jabatan sejak dijalani secara faktual, maka ahli dari Pihak Terkait, I Gde Pantja Astawa, menyatakan bahwa masa jabatan terhitung sejak pelantikan.

Dalam hal ini, Astawa mengutip ketentuan Pasal 60 Undang-Undang Nomor 23 Tahun 2014 yang menyebutkan, “Masa jabatan kepala daerah sebagaimana dimaksud dalam Pasal 59 ayat (1) adalah selama lima tahun terhitung sejak pelantikan dan sesudahnya dapat dipilih kembali dalam jabatan yang sama hanya untuk satu kali masa jabatan”.

Perbedaan pandangan dalam penghitungan masa jabatan kepala daerah ini menjadi inti pembahasan di persidangan. Sebabnya, Pemohon, Termohon (KPU Tasikmalaya) serta Pihak Terkait memiliki versi hitung-hitungan yang berbeda mengenai masa jabatan dan periodisasi jabatan Calon Bupati Ade Sugianto yang merupakan petahana.

Sebelum menang sebagai Bupati dalam kontestasi Pilkada Tasikmalaya 2020, Ade sempat menjabat Bupati juga. Saat itu dia yang merupakan Wakil Bupati, naik menjadi Bupati menggantikan Uu Ruzhanul Ulum yang terpilih sebagai Wakil Gubernur Jawa Barat bersanding dengan Ridwan Kamil sebagai Gubernur.

Namun yang menjadi soal dalam perkara ini ialah, jabatan Ade Sugianto saat transisi terpilihnya Uu Ruzhanul sebagai Wakil Gubernur Jawa Barat sehingga meninggalkan kekosongan jabatan Bupati Tasikmalaya. Masa transisi itu terjadi sejak 5 September 2018, di mana Ridwan Kamil dan Uu Ruzhanul Ulum dilantik sebagai Gubernur dan Wakil Gubernur Jawa Barat.

Bertepatan dengan pelantikan itu, Ridwan Kamil menerbitkan Surat Telegram atau Radiogram mengenai kekosongan posisi Bupati Tasikmalaya yang ditinggalkan Uu. Hal demikian disampaikan di persidangan oleh saksi dari Pemohon, Asop Sopiudin yang merupakan Anggota Dewan Perwakilan Rakyat Daerah (DPRD) Kabupaten Tasikmalaya.

"Terbit Telegram Gubernur Provinsi Jawa Barat, Pak Ridwan Kamil pada 5 September 2018. Pada saat itu bertepatan dengan dilantiknya Gubernur dan Wakil Gubernur Jawa Barat. Saya ikut menghadiri pelantikan tersebut," kata Asop saat bersaksi di persidangan.Petikan Telegram Ridwan Kamil tersebut berbunyi: “Dalam rangka menjamin keberlangsungan Pemerintahan Daerah di Kabupaten Tasikmalaya agar saudara Wakil Bupati Tasikmalaya melaksanakan tugas dan wewenang Bupati Tasikmalaya sesuai peraturan perundang-undangan sampai dengan dilantiknya Bupati Tasikmalaya.Pemohon dalam perkara ini memaknai petikan Radiogram tersebut bahwa Ade Sugianto telah menjabat Bupati Tasikmalaya sejak 5 September 2018. Hal itu karena Ade secara faktual menjalankan tugas dan wewenang sebagai bupati meskipun tidak melalui pelantikan.

 

Ahli yang dihadirkan Pemohon pun menyampaikan bahwa penghitungan masa jabatan tidak membedakan antara menjabat secara definitif alias melalui pelantikan maupun menjabat sementara.

"Dua unsur yang penting dalam memaknai belum pernah dua kali menjabat adalah satu periode dimaknai telah menjalani setengah atau lebih dan tidak membedakan antara yang definitif ataupun yang tidak," ujar Ibnu Sina Chandranegara, ahli dari Pemohon.

Sebaliknya, Termohon dan Pihak Terkait memaknai bahwa dari Radiogram tersebut, Ade hanya menjalankan tugas dan wewenang sebagai bupati. Namun jabatannya, tetap sebagai Wakil Bupati Tasikmalaya.

"Sebelum dilantik, Haji Ade Sugianto sebagai Wakil Bupati yang menjalankan tugas wewenang Bupati Tasikmalaya sampai dengan dilantiknya bupati definitif, sesuai dengan Radiogram Gubernur tanggal 5 September 2018," ujar Sekretaris Daerah Pemerintah Kabupaten Tasikmalaya, Mohammad Zen yang dihadirkan sebagai saksi oleh Termohon di persidangan.

Adapun pelantikan Ade sebagai Bupati Tasikmalaya secara definitif untuk menggantikan Uu Ruzhanul, dilakukan sekira tiga bulan kemudian, yakni 3 Desember 2018. Pelantikan Ade sebagai Bupati definitif dilakukan berdasarkan Keputusan Menteri Dalam Negeri (Mendagri).

Setelah itu, terdapat surat dari DPRD Tasikmalaya kepada Gubernur Jawa Barat yang mengingatkan bahwa masa jabatan Bupati berakhir pada 23 Maret 2021. Merespons surat DPRD tersebut, Gubernur Jawa Barat kemudian bersurat kepada Mendagri untuk memberikan usulan agar ada pemberhentian Bupati Tasikmalaya pada 23 Maret 2021. Atas usulan Gubernurr Jawa Barat itu, Mendagri kemudian menerbitkan Surat Keputusan (SK) pemberhentian Ade sebagai Bupati Tasikmalaya.

Perbedaan versi penghitungan masa jabatan kembali terjadi pada titik ini. Sebabnya, SK diterbitkan Mendagri pada 26 April 2021, sehingga menjadi acuan Pemohon menghitung masa jabatan Ade sebagai Bupati. Namun dari kubu Termohon menjelaskan, meski terbit pada 26 April, isi surat tersebut memberhentikan Ade sebagai Bupati sejak 23 Maret 2021.

Dengan demikian, Pemohon menghitung masa jabatan Ade sebagai Bupati selama 2 tahun 7 bulan 18 hari. Hitungan itu menurut Pemohon sudah masuk satu periode, mengingat pemaknaan setidak-tidaknya sudah menjalani setengah masa jabatan.

Adapun satu periode lainnya, saat Ade terpilih sebagai Bupati Tasikmalaya pada Pilkada 2020. Jika ditotalkan, maka menurut Pemohon, Ade telah menjabat Bupati Tasikmalaya selama dua periode.

Sedangkan versi Termohon, Ade menjabat sebagai Bupati selama 2 tahun 3 bulan 20 hari. Jumlah tersebut menurut Termohon tidak memenuhi setengah masa jabatan kepala daerah, yakni 2 tahun 6 bulan atau 2,5 tahun, sehingga tidak terhitung satu periode.

"Pelantikan pada periode 2018-2021 yaitu 3 Desember 2018 dan berakhir pada 23 Maret 2021, sehingga menjabat Bupati Tasikmalaya selama 2 tahun 3 bulan 20 hari. Artinya tidak terhitung satu periode masa jabatan," tutur Mohammad Zen.

 

Tinta Pena dan Fasilitas

Mengenai jabatan, tak terlepas dari fasilitas negara yang memang disediakan bagi kepala daerah. Pihak Terkait, yakni Ade Sugianto diwakili kuasa hukumnya memastikan bahwa dirinya tidak menggunakan fasilitas Bupati Tasikmalaya sebelum dilantik.

Hal demikian diperkuat Pihak Terkait dengan menghadirkan Asisten Administrasi Sekda Tasikmalaya, Iin Aminudin di persidangan kali ini. Iin yang pernah menjabat sebagai Plh Sekda sejak 26 November 2018, memastikan bahwa Ade selalu mengklaim dirinya sebagai Wakil Bupati sebelum dilantik sebagai Bupati definitif pada 3 Desember 2018.

Pun dengan fasilitas, menurut Iin Ade menggunakan fasilitas yang memang disediakan untuk Wakil Bupati.

"Yang saya ketahui bahwa fasilitas-fasilitas lainnya, sarana dan prasarana, Pak Ade ini sebagai wakil bupati menggunakan fasilitas wakil bupati. Tidak menggunakan fasilitas bupati, termasuk tinggal," ujarnya di persidangan.

Tak hanya fasilitas, kuasa hukum Pihak Terkait juga membawa bukti sejumlah produk dokumen yang ditandatangani Ade saat masa transisi hingga menjabat definitif sebagai Bupati Tasikmalaya. Menurut kuasa hukum Pihak Terkait, seluruh dokumen yang ditandatangani bupati menggunakan pena bertinta hijau. Sedangkan dokumen yang ditandatangani wakil bupati berwarna biru.

Sampel produk dokumen yang ditandatangani tersebut diminta Hakim untuk dibawa ke meja Majelis Hakim Panel. Para pihak pun dipersilakan untuk turut mendekat ke meja hakim untuk melihat dokumen-dokumen tersebut.

"Itu yang membedakan. Diatur di dalam Perbup (Peraturan Bupati). Jadi Kepala Daerah itu warna hijau tanda tangannya. Itu terhitungnya setelah Desember," ujar Kuasa Hukum Pihak Terkait, Tanda Perdamaian Nasution saat menunjukkan dokumen di hadapan Majelis.

 

Menunggu Putusan

Dengan dihadirkannya para saksi dan ahli dari berbagai pihak untuk memberikan keterangan, maka persidangan akan berlanjut dengan agenda Pengucapan Putusan. Adapun putusan perkara ini akan dibacakan pada Senin (24/2/2025) mendatang.

Namun sebelum itu, Majelis Panel Hakim 1 akan membawa hasil sidang pemeriksaan hari ini ke dalam Rapat Permmusyawaratan Hakim (RPH).

"Hasil dari pemeriksaan ini akan kami laporkan dari hakim panel ke Rapat Permusyawaratan Hakim di dalam Rapat Pleno. Kemudian Mahkamah akan mengagendakan Pengucapan Putusan pada 24 Februari 2025," ujar Ketua MK Suhartoyo di persidangan.

Dengan demikian, para pihak sudah tidak bisa lagi mengajukan penambahan alat bukti maupun melakukan inzage. Para pihak pun akan memperoleh panggilan secara resmi melalui Kepaniteraan MK untuk menghadiri Sidang Pengucapan Putusan tersebut.Sebelumnya, Pemohon perkara ini telah membacakan Permohonan pada Sidang Pemeriksaan Pendahuluan. Dalam permohonannya, Pemohon telah mendalilkan soal masa jabatan Pihak Terkait selama dua periode yang menurut Pemohon yang melebihi syarat pencalonan bupati dan wakil bupati. Di antara dua kali masa jabatan itu, pertama, berlaku sejak 3 Desember 2018 hingga 26 April 2021 sebagai Bupati Tasikmalaya definitif. Jika diakumulasikan, Pihak Terkait menjabat selama 2 tahun 7 bulan 18 hari. Kemudian untuk periode kedua, Pemohon mendalilkan bahwa Pihak Terkait telah menjabat sebagai Bupati Tasikmalaya pada tahun 2021 sampai 2025.

Atas dalil permohonan ini, Pemohon menyampaikan petitum, memohon agar MK mendiskualifikasi Pihak Terkait dalam Pemilihan Bupati dan Wakil Bupati Tasikmalaya 2024. Selain itu, Pemohon juga meminta agar Majelis menetapkannya sebagai pemenang dan memerintahkan Komisi Pemilihan Umum Daerah (KPUD) Tasikmalaya melakukan pemungutan suara ulang. (Sumber MK Jakarta)

Ini  yang saya ketahui artinya keputusannya memang sedang dalam proses oleh para pemilik otoritas demi kekuatan hukum yang sah. artinya sementara ini saya tidak dapat masuk terlalu jauh kedalam hal ini namun saya percaya bahwa Suhartoyo dan yang lainnya lebih suka buat mengambil keputusan tanggal 26 pebruari 2025, setidaknya lebih mementingkan bukti daripada alibi mereka.yang telah dua kali menjadi bupati maunya tiga kali. melihat keadaan ini bagi tidak mungkin bisa terjadi. oleh sebab bukti - bukti telah menjadi bupati dua kali sangat kuat oleh sebab itu saya berkeyakinan pasti ada yang gugur demi hukum. demikian andri elyus luntungan mengahiri perkataannya. During the three months following passage of the tax bill, the average American saw a $6.21 increase in average weekly earnings. Assuming 12 weeks of work during the three months following passage of the corporate tax cuts, this equates to a $75 increase.

Assuming a full 52 weeks of work, the $6.21 increase in weekly earnings would result in a $323 annual increase, nowhere near the minimum $4,000 promised and $9,000 potential annual increases projected by President Trump and Speaker Ryan if significant cuts were made to corporate tax rates.

Unless something drastically changes, it seems that Americans are going to have to settle for much less than the $4,000 to $9,000 projected wage increases. An extra $322 a year isn’t going to do much to pay down the $1 trillion in additional debt they are projected to take on as a result of the tax cuts.

Yet, a key part of the argument for the recently passed corporate tax cuts and more than a trillion dollars in debt was the substantial wage hike promised by the president’s Council of Economic Advisers (CEA).

From a document titled, “Corporate Tax Reform and Wages: Theory and Evidence,” on the White House’s website:

“Reducing the statutory federal corporate tax rate from 35 to 20 percent would, the analysis below suggests, increase average household income in the United States by, very conservatively, $4,000 annually.”

The document goes on to say:

“When we use the more optimistic estimates from the literature, wage boosts are over $9,000 for the average U.S. household.”

No less than Speaker Ryan’s website trumpeted the Council of Economic Advisers report claiming that on average, the proposed corporate tax cuts would result in at least a $4,000 annual increase in wages.

Now, some supporters of the tax bill may say this analysis is unfair because it is too early for the effects of the tax bill to show up in wages. By that logic, they also shouldn’t take credit for reported employment growth increases.  

Still others may point to the $1,000 bonuses announced by some companies shortly after passage of the tax bill. First, that is significantly less than the promised $4,000 to $9,000. Second, these are not wage increases; these are one-time bonuses.

Will companies pay them again, and if so when? Third, the $1,000 represents a fraction of the estimated potential company tax savings.

Using 2016 net income, 2016 effective tax rates, the new 21-percent corporate tax rate and company bonuses, we estimated company bonuses as a percentage of a number of company’s potential tax savings. The results: In many cases, the bonuses represent a mere pittance of the possible tax savings.

Navient announced that it would be giving $1,000 bonuses to 98 percent of its 6,7000 employees, paying out nearly $7 million in bonuses. While that may seem generous, it pales in comparison to Navient’s potential tax savings.

Using Navient’s 2016 net income, its 2016 effective tax rate, estimated annual tax savings of nearly $200 million and its announced bonuses, we calculated that the announced bonuses represent less than 4 percent of Navient’s potential tax savings.

Turning to the airline industry, JetBlue’s employees might be feeling blue if they realized that their $1,000 bonuses are estimated to be less than 10 percent of JetBlue’s potential tax savings, while American Airlines’ bonuses are estimated to represent less than 15 percent of its estimated potential annual tax savings

Not to be outdone, Comcast’s bonuses represent less than 8 percent of its estimated potential annual tax savings, while Walmart appears downright generous, giving an estimated $0.16 of every dollar of its estimated potential annual tax savings to employees in the form of bonuses.

What happened to the minimum $4,000 promised? I guess like many promises by politicians, they were empty. Instead, they seem to have gone to share buybacks. For the period December 2017 through February 2018, share buybacks more than doubled to $200 million.

Is a $323 wage increase and a one-time bonus of $1,000 that represents a fraction of estimated potential company tax savings worth the more than $1 trillion in additional debt placed on Americans? Is this the best Congress could do? No.

Instead, Congress could have simply made each company’s tax cut contingent on each company increasing wages. The problem is that some companies receiving tax cuts didn’t raise wages.

If Congress had made each company’s tax cut contingent on each company’s wage increases, the American people would have gotten more bang for their tax cut bucks. Additionally, this would have created a real incentive for companies to raise wages: Increase wages, get a tax cut; don’t and you won’t.

If the justification for saddling the American people with at least $1 trillion in additional debt was greater wage growth, tax cuts should have been tied to each company’s wage growth; that’s just logical. That’s getting a better deal for the American people, and that’s getting a better return on investment.

France issues report detailing evidence of Assad role in chemical attacks

France declassified a report on Saturday laying out evidence that officials said proves that a chemical attack in Syria last week was carried out by the government of President Bashar Assad.

The report claims that several chemical strikes were carried out in the Damascus suburb of Douma on April 7, and that symptoms experienced by the victims — skin burns, suffocation and other breathing difficulties, among other markers — were consistent with the effects of chlorine gas.

"Reliable intelligence indicates that Syrian military officials have coordinated what appears to be the use of chemical weapons containing chlorine on Douma, on April 7," the report, released by the French Foreign Ministry, reads.

The report also states that the Syrian government has carried out a number of chemical weapons strikes since April 4, 2017 — the same day a chemical attack in Syria's northern Idlib province left more than 80 civilians dead.

The U.S. issued an assessment on Friday night pointing to the Syrian government's role in the alleged chemical attacks in Douma.

That report cites "multiple media sources, the reported symptoms experienced by victims, videos and images showing two assessed barrel bombs from the attack, and reliable information indicating coordination between Syrian military officials before the attack."

The assessment also suggests that the Syrian government not only used chlorine in the attack on Douma, but that reported symptoms were also consistent with exposure to sarin, a deadly nerve agent.

The French and U.S. assessments came hours after leaders in Washington, Paris and London authorized "precision strikes" on targets in Syria believed to be associated with the country's chemical weapons arsenal.

Syria and its allies, Russia and Iran, have denied that Assad's government used chemical weapons, and have sought to blame both foreign actors and militant groups for staging the attacks in Douma.

Russia has accused the U.S. and its allies of failing to produce adequate evidence of the Syrian government's role in the chemical attack.

The Organization for the Prohibition of Chemical Weapons, the international chemical weapons watchdog, launched an investigation into the alleged chemical strikes on Douma on Saturday.

The allied strikes on Friday were cast by U.S. officials, not as a punishment for Assad's government, but as a means to eradicate Syria's chemical stockpile and production capabilities.

Lt. Gen. Kenneth McKenzie, the director of the Joint Staff, said Saturday that while the allied attacks dealt a blow to Syria's chemical weapons program, Damascus likely retained "residual" elements of its chemical arsenal.

It is not clear why Michael Cohen was in Prague. The claim he visited was originally made in a dossier compiled by former British spy Christopher Steele.

Cohen denied that he'd ever been to Prague "in my life" after the dossier's publication, tweeting a photo of his passport.

McClatchy reported that Cohen entered the country through Germany in August or early September 2016, which does not require a passport stamp.

The dossier claimed that, in Prague, Cohen met with a prominent ally of Russian President Vladimir Putin, Konstantin Kosachev, but it is not clear whether Mueller has evidence of such a meeting.

Koschahev was one of 24 Russian oligarchs slapped with U.S. sanctions earlier this month.

If such a meeting happened, it would be further evidence of ties between Trump associates and Putin. The dossier also claims that Cohen, among others, was deeply involved in a “cover up and damage limitation operation in the attempt to prevent the full details of Trump’s relationship with Russia being exposed.”

Neither Cohen nor Mueller commented on the story to McClatchy.

The report comes on the same day that U.S attorneys confirmed that they are investigating Cohen for criminal activity.

The FBI raided Cohen's office and home on Monday, in part on a referral from Mueller's office.

4 December – In the wake of a grand jury decision in New York yesterday not to indict a police officer in the chokehold death of Eric Garner, an unarmed man, in July, United Nations Secretary General Ban Ki-moon has urged the United States to do “anything possible to respond to demands of greater accountability.”

25 November – Amid rising tensions Port-au-Prince and other key Haitian cities in the wake of last month’s delayed elections, the top United Nations official in the country deplored the violence that recently caused injuries among demonstrators and called on all sides to respect the right to free expression while also avoiding any recourse to violence.


Mexico: UN rights office notes ‘deep concerns’ over case of missing students

14 November – The United Nations Human Rights Office (OHCHR) today cautioned against jumping to conclusions regarding the “complex and ongoing” investigation into the disappearance of 43 students in Mexico, amid reports that a number badly burned bodies have been recovered from sites in Guerrero state.


13 November – The top United Nations coordinator for cholera response in Haiti says support for initiatives to combat the disease has been “disappointing,” noting that while it may be possible to eliminate cholera in about a decade, at the current rate of funding, it would take more than 40 years to do the job.
